- Informationspflicht gemäß § 413 HGB gegenüber dem Frachtführer. Dieser muss die für die Beförderung erforderlichen Informationen und Urkunden erhalten. Bei Unvollständigkeit ist die Folge eine Haftung nach § 414 HGB.
- Der Frachtführer muss nur die Betriebssicherheit der Verladung sicherstellen.
- Der Absender hingegen muss mit geeigneten Maßnahmen dafür sorgen, dass der Empfänger das bei ihm angekommene Gut auch entlädt. Damit ist der Absender insoweit für die Vorgehensweise des Empfängers verantwortlich.
Auf Seiten des Frachtführers ist besonders das Recht auf ein Standgeld gemäß § 412 HGB relevant:
- Für eine angemessene Entladezeit kann keine besondere Vergütung verlangt werden.
- Überschreitet der Frachtführer jedoch aus Gründen, die nicht in seinem Risikobereich liegen, die Lade- oder Entladezeit, hat er einen Anspruch auf ein angemessenes Standgeld.
