Not every reproduction is punishable. A copyrighted work may be reproduced for personal and other private use, Section 53 UrhG. Personal use is circumscribed by the fact that it is limited to the private sphere, i.e. only persons who have a personal relationship with each other may be involved.

 

Distinction: permissible and impermissible reproduction of a work

Permitted reproductions of a work may be in particular

  • for the author's own scientific use
  • for inclusion in one's own archive
  • for own information and
  • for other personal use.

 

However, it is a criminal offence to distribute a work if the original or copies are offered to the public (commercially) or put on the market.

Criminal prosecution is possible for our legal and specialist lawyers without a criminal complaint if the public prosecutor's office deems it necessary to intervene ex officio due to the special public interest. In this context, items relating to a copyright offence can also be confiscated in the course of house searches.
